The HOPE Program (“HOPE”; “we”; “us” or “our”) is committed to safeguarding your privacy and ensuring the highest standards of integrity in all fundraising efforts and to the ethical collection, retention, and use of information on donors, prospects, and general users. This Privacy Policy is designed to help you understand our practices in connection with the information we collect from visitors to our websites, our sponsors, donors, and supporters (“you”) through (https://www.thehopeprogram.org/) (“Site”) and through offline interactions that we may have with you (collectively “Services”). Defined terms used in this Privacy Policy are explained in Section 15 below.

This Privacy Policy describes HOPE’s policies and procedures on the collection, use, and disclosure of your information when you use our Services. Please read this Privacy Policy carefully before you start to use the Services. By using the Site or participating in certain of the Services, including donations to HOPE, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should elect not to visit the Site or use the Services. 

HOPE reserves the right to change this Privacy Policy at any time at its sole discretion by posting revisions on the Site. Such revisions will be effective immediately upon posting them to the Site. Your use of the Services after such changes have been posted shall constitute your acceptance of the terms of the revised Privacy Policy. 1. Collection of Personal Information

We may collect or obtain Personal Information about you from the following sources:

  • Data You Provide to Us: We may obtain Personal Information when those data are provided to us (e.g., where you contact us via email or telephone, or by any other means such as subscribing to our newsletters or other publications).
  • Data We Obtain In Person: We may obtain Personal Information during meetings, fundraising events, or at events we attend.
  • Collaborations: We may obtain Personal Information when you collaborate with us in research or in an advisory/consultancy capacity.
  • Relationship Data: We may collect or obtain Personal Information in the ordinary course of our relationship with you.
  • Data You Make Public: We may collect or obtain Personal Information that you manifestly choose to make public, including via social media (e.g., we may collect information from your social media profile(s), if you make a public post about us).
  • Site Data: We may collect or obtain Personal Information when you visit our Sites or use any features or resources available on or through a Site.
  • Registration: We may collect or obtain Personal Information when you use, or register to use, any of our Services.
  • Third Party Information: We may collect or obtain Personal Information from third parties who provide it to us (e.g., business partners including advertising/marketing partners, data providers such as information/database services and/or data suppliers, information credit reference/reporting agencies, law enforcement authorities, etc.).

2. Creation of Personal Information

We may also create personal information about you in certain circumstances, such as your records of your interactions with us, and details of your past interactions with us. We may also combine personal information from any of our Sites, or Services, including where those data are collected from different devices.

3. Information We Collect

We may collect the following categories of Personal Information about you:

  • General Information: Information you provide when you contact to our Services such as electronic mailing lists for newsletters, including name, mobile phone number, email address, occupation, and any other information from users who choose to send it to use by email, and credit card or other payment information.
  • Relationship Information: Records and copies of your correspondence (including but not limited to email addresses, phone numbers, photographs, and video), if you contact us with feedback.
  • Payment Data: We use third-party payment processors to process payments made to us, which is not permitted to store, retain, or use billing information except for the purpose of credit card processing on HOPE’s behalf. More detailed credit card or bank account information may be collected by our payment processors, whose use of your information is governed by their privacy policies.
  • Demographic Information: Gender; date of birth / age; nationality; salutation; title; and language preferences.
  • Consent Records: Records of any consents you have given, together with the date and time, means of consent, and any related information (e.g., the subject matter of the consent).
  • Device Information: We may collect information about your mobile device and internet connection, including the device’s model, unique device identifier, IP address, operating system, and mobile network or Wi-Fi information.
  • Employer Details: Where you interact with us in your capacity as an employee of a third party; and the name, address, telephone number and email address of your employer, to the extent relevant.
  • Cookie Data: We collect information via cookies, pixels and similar technologies. For more information, please see Section 10 below.
  • Views and Opinions: Any views and opinions that you choose to send to us, or publicly post about us on social media platforms

Please note that HOPE may also offer you the opportunity to donate anonymously. If you elect to do so, your donation information will be shared only with our third party processor; the processor will share only the amount of your donation with HOPE, and none of your other personal information.

4. Sensitive Personal Information

With your permission, we may collect some information from you that is considered sensitive personal information. We do not sell or share sensitive personal information with any third-parties for cross-context behavioral advertising or to use for their own purposes.

For your information, personal information does not include publicly available information from federal, state, or local government records, and de-identified or aggregated consumer information.

5. How We Use Your Information

We may use the information we collect about you for the following purposes:

  • To develop, operate, maintain, deliver, protect, and improve our Services.
  • To process or fulfill orders, transactions, and payments.
  • To provide support and technical assistance.
  • To enhance the safety and security of our Services.
  • To send you communications related to our Services, including but not limited to updates and alerts.
  • To monitor and analyze trends and usage.
  • To verify your identity and prevent fraud or other unauthorized or illegal activity.
  • To investigate, enforce, and report violations of our Terms of Use and/or other policies.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
  • To assist in the resolution of legal claims, including but not limited to the following: to establish facts and legal claims; and to exercise and defend legal rights and claims, including in formal legal proceedings.
  • To comply with applicable laws, regulations, and legal processes.
  • To fulfill any other purpose for which you provide it.
  • To identify and investigate unauthorized vehicles on our premises and communicate with their drivers regarding fines.
  • To use for ordinary fundraising and relationship-building purposes with the user, in addition to internal analyses to further those business purposes.
  • To analyze giving patterns, make more accurate budget projections, and solicit future donations.
  • HOPE also keeps a record of each donor’s giving history for IRS purposes.

HOPE does not exchange, give, sell, or rent its donor file to any other party or organization.

6. How We Share Your Information

We will only disclose personally identifiable information we collect from you to third parties without your permission to the extent necessary to:

  • you and, where appropriate, your appointed representatives;
  • comply with the law or in response to a subpoena, court order, government request, or other legal process;
  • protect the interests, rights, safety, or property of HOPE, its affiliates, employees, or agents;
  • legal and regulatory authorities, upon request, or for the purposes of reporting any actual or suspected breach of applicable law or regulation;
  • accountants, auditors, consultants, lawyers and other outside professional advisors to HOPE, subject to binding contractual obligations of confidentiality; third party service providers, including credit reporting bureaus or to process your transactions through financial institutions, including payment card processors and ACH processors. These
    companies are authorized to use your Personal Information only as necessary to provide these services to us.
  • any relevant party, regulatory body, governmental authority, law enforcement agency or court, to the extent necessary for the establishment, exercise or defense of legal claims;
  • any relevant party, regulatory body, governmental authority, law enforcement agency or court, for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties;
  • enforce this Privacy Policy;
  • any relevant third-party acquirer(s) or successor(s) in title, in the event that we sell or transfer all or any relevant portion of our business or assets (including in the event of a reorganization, dissolution or liquidation); and
  • address fraud, security, technical issues, or to operate HOPE’s systems properly.

We may store personal information in locations outside the direct control of HOPE (for instance, on servers or databases collocated with hosting providers). We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

7. Data Security and Integrity

HOPE uses commercially reasonable efforts to safeguard the privacy and integrity of any personally identifiable information (name, mailing address, email address, etc.) collected though our Services. We have implemented checks designed to protect your Personal Information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized forms of processing, in accordance with applicable law.

Please note however that transmissions made via the Internet cannot be made absolutely secure. Although we will implement all reasonable measures to protect your personal information, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk, and you are responsible for ensuring that any personal information that you send to us is sent securely.

8. Children’s Privacy

HOPE does not knowingly collect or solicit personal information from anyone under the age of thirteen (13). If we become aware that we have inadvertently collected personal information (as defined by the Children’s Online Privacy Protection Act) from a child under the age of thirteen without verified parental consent, we will delete that information from our records. If you believe we might have any information from or about a person under 13, please contact us at operations@thehopeprogram.org.

9. Direct Marketing

We may process certain Personal Information to send marketing communications about our Services, unless prohibited by applicable law (or unless you have opted out). In some instances, we may request your consent to send you promotional and/or marketing information. We also may use the information that you provide to us, as well as information from other sources, such as your use of our Services, to customize communications pertaining to our Services that may be of interest to you.

You may unsubscribe from our promotional email list at any time by simply clicking on the unsubscribe link included in every promotional electronic communication we send. Please note that it may take up to 2 weeks to process your unsubscribe request during which time you may continue to receive
communications from us. After you unsubscribe, we will not send you further promotional emails, but in some circumstances, we will continue to contact you to the extent necessary for the purposes of providing the Services you have requested.

10. Tracking Technologies
 
This provision explains how HOPE uses cookies, pixels, and similar technologies in connection with the Services. As is true of most web sites, we gather certain information automatically and store it in log files. This information may include which URL you just came from, which URL you go to next, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically with other information we collect about you. We do this to improve marketing, analytics, or site functionality. This collective data helps us determine how much our visitors use parts of the Site, and helps us do internal research on our users’ demographics, interests, and behavior to better understand and serve you.
 
Similarly, the Site may also place a “cookie,” or small file, in the browser of a visitor’s computer. This cookie will assign a user a unique number that allows HOPE to save information so that the information does not need to be reentered. At no time will this cookie reveal your personally identifiable information to others. HOPE does not sell, share, or rent this information under any circumstances.

HOPE may provide links to other web sites. Be advised that we do not control, and we are not responsible for the privacy practice or the content of those web sites. We suggest you read the privacy policies posted on each site.
 
12. Governing Law
 
You agree that your use of this Site, this Privacy Policy and any disputes relating thereto, shall be governed in all respects by the laws of the State of New York. Any dispute relating to this Privacy Policy shall be resolved solely in the state or federal courts located in Manhattan, New York.
 
13. Restrictions on Use
In keeping with HOPE’s goals and mission, it is HOPE’s policy to allow limited reproduction and distribution of the materials posted on our Site, unless particular materials are specifically restricted as noted on individual Web pages. Accordingly, you may copy, reproduce, and distribute content from this Site, provided that: (1) the particular article or section is reproduced in its entirety in its original form and that you do not edit or otherwise change the substance or the content of material that you copy from the Site, or change or delete any copyright, trademark, and other proprietary notices; (2) all copies include a statement that the material was reproduced from www.thehopeprogram.org with the permission of HOPE; (3) the copies are distributed only for noncommercial educational or public policy purposes; and (4) the copies are distributed at no charge. Provided you comply with all of these conditions, HOPE grants you a nonexclusive, nontransferable license to reproduce, copy, and distribute the materials on our Site.

Requests to change or delete your personal information, or to opt out of receiving marketing emails from HOPE, will be honored within 10 business days of your request.
 
15. Definitions
 
“Cookie” means a small file that is placed on your device when you visit a website (including our Sites). In this Privacy Policy, a reference to a “cookie” includes analogous technologies such as pixels, web beacons, and clear GIFs.
 
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include (i) publicly available information from government
records; (ii) de-identified or aggregated consumer information; (iii) personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or Driver’s Privacy Protection Act of 1994.
 
Process”, “Processing” or “Processed” means anything that is done with any Personal Information, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
 
Sensitive Personal Information” means Personal Data about race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, biometric data, physical or mental health, sexual life, citizenship or immigration status, genetic or biometric data that uniquely identifies an individual, personal data of a known child, precise geolocation data, any actual or alleged criminal
offences or penalties, national identification number, or any other information, financial information in certain circumstances, that are deemed to be sensitive under applicable law.
